The Comforted Kitty, LLC Legal Terms and Conditions & Veterinary Release Agreement

For the purpose of this document, the terms Client, Pet Owner, and Owner are synonymous with the person contracting services for one or more cats, and Cat Sitter, Sitter and Company are synonymous with the company (The Comforted Kitty) contracted to provide such services.

 

    1. Payment is due by the due date specified on the invoice emailed to the client. The fee is $35 per 30 minute visit, $45 per 45 minute visit, $55 per 60 minute visit. Preferred payment methods are credit card or ACH bank transfer through your Time To Pet software portal, Venmo, Chase QuickPay, Zelle, Google Pay, and Square Cash, check, and cash.
    2. A holiday fee of $15 per visit will be charged on New Year’s Day, Martin Luther King Jr. Day, President’s Day, Easter Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veteran’s Day, Thanksgiving Day, Christmas Eve, Christmas Day, and New Year’s Eve.
    3. Cancellation of a sitting with less than 48 hours notice from the scheduled start date of the sitting will incur a $25 fee. The remaining payment will be held on file as credit for future sitting requests. We do NOT offer cash refunds. This policy applies only to dates not specified in the holiday periods listed below.
    4. There are NO cash refunds or credits for early return from scheduled trip.
    5. Cancellations during Non-Winter-Holiday periods (as listed below and on our website) require the appropriate notice as listed on our website under the Policies page or client will be charged the full amount of each sitting cancelled within that holiday period. No cash refunds or credit will be given for these visits.
    6. Full payment is due at time of booking for all sittings scheduled for the Thanksgiving, Christmas, and New Year’s holiday periods listed on our website, or your booking will be cancelled. Changes or cancellations with at least 21 days advance notice prior to first visit are 100% refundable as credit for entire schedule that can be used for future sittings. No cash refunds will be given. Changes or cancellations with less than 21 days advance notice prior to first visit are nonrefundable and cannot be used as credit towards future sittings.
    7. Client agrees to contact The Comforted Kitty when they arrive back home. Contact can be by email, text, or phone call.
    8. Regarding your home keys, we request two working copies be provided at the time of the initial consultation meet and greet (one set as a backup in case the other is lost or other emergency occurs). If you are not able to provide a second set, please let us know so that we can discuss other options for a backup set. If your apartment complex does not allow duplicating the necessary keys or fobs or you are otherwise unable to give us a single set at the initial consultation, a $10 pickup fee will be charged for the sitter to pick them up from you at a later date before the start of the first scheduled sitting. If you choose not to have us hold your keys on file for future sitting requests, a $10 key pickup fee will apply the next time you request services. If you choose to have us return the keys at a later date, a $10 key return fee will apply. Keys can be mailed back to you via certified mail for a $5 fee. Alternatively, we welcome having keys stored securely in a lockbox for the sitter to retrieve on the first visit and return to it on the last visit. This avoids all of the fees and extra liability noted above. And it makes things very simple to coordinate for future sitting requests. Please note we do not allow clients to drop off or pickup keys from an employee’s home for privacy reasons.
    9. If Client gives Cat Sitter a house key that doesn’t work properly and Cat Sitter needs a locksmith to get in, Client is responsible for all locksmith related costs as well as the Cat Sitter’s time, billed at $32 per 30 minutes.
    10. If Client returns home early from trip and the Cat Sitter was to leave the keys at the residence on the last visit, and the Client would therefore like the keys to be returned, a $10 return fee will be charged.
    11. If Cat Sitter arrives at residence but is not able to access the home for reasons outside of their control (e.g. picking up keys from leasing office that is unexpectedly closed), all waiting time will be billed a $32 per 30 minutes. If client instructs cat sitter to leave and come back at a later time of the day, a $30 fee will apply for time, gas, and mileage for commuting back and forth to the client’s residence.
    12. The Comforted Kitty is not responsible for damage to the home beyond the control of the Cat Sitter. This includes, but is not limited to, leaks, electrical problems, and acts of nature. In these situations, Cat Sitter will attempt to contact Client and then the emergency contact before making a subjective decision on dealing with the problem. All repairs and related fees will be paid by Client, or fully reimbursed to The Comforted Kitty within 14 days.
    13. The Comforted Kitty is not responsible for any damage to property of Client or others unless such damage is caused by the negligent act of Cat Sitter. And it also includes any damage as the result of any other persons not affiliated with The Comforted Kitty who have entered the home during the dates that Client has contracted cat sitting services from The Comforted Kitty as specified on this contract. The Comforted Kitty agrees to remain insured through PSA or a comparable pet sitting liability insurance entity during each service period. The Comforted Kitty accepts no responsibility for loss to the premises or an animal accidentally getting outside if other individuals (friends, neighbors, house cleaners, contractors, etc.) have access to Client’s home, or if the home is not properly secured.
    14. At the time that service is booked, Client will inform The Comforted Kitty of everyone who has been granted access to the home during the service period. All other individuals that visit the home will leave a log of their visit.
    15. The Comforted Kitty is not liable for any loss or damage in the event a burglary or other crime that should occur while under this contract that is not found to be the result of the sitter’s negligence. Client agrees to secure home prior to leaving the premises. The Comforted Kitty will attempt to re-secure the home to client instructions at the end of each visit. While keys are in possession of the Sitter, they will be either on the Cat Sitter’s physical person or be properly secured.
    16. All windows and doors, including patio doors, will stay exactly as they were when Client left. Cat Sitter will not be opening any additional windows, doors or patio doors unless Client specifies in writing. However, Cat Sitter will close any windows or doors if it’s raining or has gotten cold outside. Any open windows or doors must have secure screens so the cat can’t escape.
    17. If your cat(s) goes outside or has contact with any animals that do go outside (ex. dog lives in the same home), your cat must be up to date on flea treatment and the home must be 100% flea-free.
    18. If Client’s cat has an accident (urinating inappropriately, vomiting, etc.) in the home, The Comforted Kitty will clean it up to the best of our ability. Client must provide cleaning supplies and paper towels or rags. The Comforted Kitty is not responsible for stains or smells that we can’t remove from the carpet or floor.
    19. In the case of a returned (bounced) check, Client agrees to pay a $25 fee plus full amount owed for contracted cat sitting services.
    20. Pet Owner is responsible for supplying the necessary supplies needed for care of their cat(s) for the entire time service is provided, including but not limited to food, litter, medicines, and cleaning supplies. Pet Owner authorizes any purchase necessary for the satisfactory performance of duties. Pet Owner agrees to be responsible for the payment of such items, as well as the Cat Sitter’s time for obtaining such items, billed at $32 per 30 minutes. Client will reimburse The Comforted Kitty within 14 days for all purchases made and time billed.
    21. The Comforted Kitty is not liable for any charges, fines, or other damages resulting from the malfunction or unintended triggering of a security system.
    22. Upon request, The Comforted Kitty will provide reasonable plant maintenance. However, Cat Sitter is not liable in the event the plant becomes damaged or perishes. Please place all indoor plants together on a waterproof surface in plain sight. Please place all indoor plants together on a waterproof surface in plain sight, as The Comforted Kitty is not responsible for water damaged areas or missed plants.
    23. Pet Owner is responsible for pet-proofing house and yard, and the security fences/gates/latches. The Comforted Kitty will not be held responsible for the health and safety of free roaming cats (outdoor cats) and will also not be liable for the death, injury, disappearance, or legal consequences of any pet with unsupervised access to the outdoors.
    24. If your outdoor cat does not appear when we are providing services, we will not wait for your cat to return. We will provide food and water at all visits regardless if the cat is present or not. Client acknowledges that The Comforted Kitty business insurance will not cover the loss or injury of a free roaming pet. Free roaming pets include indoor cats that have access to outdoors (including fenced yard) via a pet door and outdoor cats (even within a fenced yard).
    25. The Comforted Kitty is authorized to seek any emergency veterinarian assistance needed during visits from any veterinarian chosen by Cat Sitter if none is specified above in the appropriate section of the agreement. Client will assume full responsibility upon return for payment and/or reimbursement for veterinary services rendered. All time spent by the sitter, such as transporting the cat, waiting at the vet office, and picking up medication will be billed at the rate of $32 per 30 minutes. Client understands that The Comforted Kitty cannot be held responsible for the results of the veterinary treatment or the loss of your pet.
    26. It is suggested that arrangements be made with someone to evacuate your cat(s) in case of a disaster or weather-related event/crisis. The Comforted Kitty will definitely try to see to your cat’s safety/care should such events occur, but cannot guarantee it.
    27. This contract permits The Comforted Kitty to accept all future telephone, online, or email reservations and provide service without additional signed service agreements.
    28. Client agrees to discuss any concerns with The Comforted Kitty within 24 hours of return after service.
    29. The Comforted Kitty agrees to provide agreed upon services in a manner that is trustworthy, caring and dependable. In consideration of the services as an express condition thereof, the client expressly relinquishes any and all claims against the company and its employees, except those arising from negligence. Claims arising from negligence that involve a hired Independent Contractor, hired by The Comforted Kitty, will be the responsibility of the Independent Contractor.
    30. This agreement is valid from the date signed, and replaces any prior Service Agreement. Client agrees to any future The Comforted Kitty term changes relayed in writing via email or mail.
    31. This contract may be terminated by either party by giving thirty days’ written notice to the other party.
    32. The Client states that he/she has read this agreement in its entirety and fully understands and accepts its terms and conditions.

Veterinary Release Agreement

**The Comforted Kitty strongly recommends that you put a credit card on file at your preferred emergency veterinary clinic in addition to your regular veterinary clinic so that treatment can begin immediately without delay from our office. Alternatively, you can enter your credit card information into our pet sitting software Time To Pet and we can charge that card. Otherwise you will need to give payment information directly to the veterinary clinic at the time of the incident while you are on your trip. We will not pay for any veterinary care treatment out of pocket from our business bank accounts. And we equally strongly advise you to at least put the name and contact information of our sitter in your veterinary office’s file record and let them know that you grant us authorization to authorize necessary veterinary care procedures in the event you are not reachable by phone, email, or text, despite repeated attempts by the sitter.**

  1. In the event that any of my cats appears to be ill, injured, or at significant risk of experiencing a medical problem at the start of service or while in the care of The Comforted Kitty, and I the client am not immediately reachable by phone, text, or email, despite repeated attempts by the cat sitter, I give permission to The Comforted Kitty to seek veterinary service from a veterinarian or a veterinary clinic. My preferred emergency veterinary hospital is listed below. If none is specified, other veterinarians or emergency care clinics chosen by the pet sitter are acceptable.
  2. I understand that efforts will be made to contact me regarding any treatments, illness, injury, or potential problems as soon as the condition is deemed not life threatening and/or contact is possible. I understand that The Comforted Kitty care providers work hard to prevent accidents and injuries, and that such problems may occur no matter how well a cat is cared for. I agree to allow The Comforted Kitty care providers to use their best judgment in handling these situations, and I understand that The Comforted Kitty and its staff assume no responsibility for the actions and decisions of the veterinary staff, the health, or death of my cat(s).
  3. Should The Comforted Kitty pay for any veterinary services on your behalf, I will assume full responsibility for the payment and/or reimbursement for any and all veterinary services rendered, including but not limited to diagnosis, treatment, grooming, medical supplies, and boarding. Such payments will be made within 7 days of the initial incident. I also agree to be responsible for all Special Circumstances Payment Rate fees assessed by The Comforted Kitty for emergency transportation, wait time at veterinary office, and supervision, and will pay such fees within 7 days of each incident.
  4. I further authorize The Comforted Kitty and my primary veterinarian(s) to share all of the medical records of all of my animals with veterinary clinics in an emergency in the interest of providing the best care for my ill or injured animal(s).
  5. I agree to notify The Comforted Kitty of any signs of injury or possible illness before any visit as soon as the condition appears. The Comforted Kitty reserves the right to cancel service at any location where a cat with a potentially infectious condition exists. The Comforted Kitty strives to provide clean, safe service to each of our clients. In doing so, The Comforted Kitty strongly recommends that each cat be vaccinated, dewormed, and protected from harmful insects according to veterinarian recommended standards.
  6. This agreement is valid from the date below and grants permission for future veterinary care without the need for additional authorization each time The Comforted Kitty cares for one or more of my pets. I understand that this agreement applies to all of the pets and large animals within The Comforted Kitty’s care. In signing this contract, I agree that I have the sole authority to make health, medical, and financial decisions regarding the animals that will be scheduled to receive service from The Comforted Kitty.

2019 Holiday Periods and Payment and Cancellation Policies

Martin Luther King Jr. Day Holiday:

  • $15 fee per visit on January 21 itself but none of the surrounding dates.
  • Full payment is due on January 18 or by the start of the first scheduled sitting, whichever comes first.
  • There are no refunds or credits for cancellations between Friday, Jan 18 – Tuesday, Jan 22.
  • Payment for any other dates outside of the period listed above can be used as credit towards future sitting requests unless the cancelled sittings are a result of an early return home after which the first scheduled sitting has commenced. No refunds or credits will be issued for such cancellations.

Presidents’ Day Holiday:

  • $15 fee per visit on February 19 itself but none of the surrounding dates.
  • Full payment is due on February 17 or by the start of the first scheduled sitting, whichever comes first.
  • There are no refunds or credits for cancellations between Sunday, Feb 17 – Tuesday, Feb 21.
  • Payment for any other dates outside of the period listed above can be used as credit towards future sitting requests unless the cancelled sittings are a result of an early return home after which the first scheduled sitting has commenced. No refunds or credits will be issued for such cancellations.

Easter Day Holiday:

  • $15 fee per visit on April 21 itself but none of the surrounding dates.
  • Full payment is due on April 16 or by the start of the first scheduled sitting, whichever comes first.
  • There are no refunds or credits for cancellations between Friday, Apr 19 – Tuesday, Apr 23.
  • Payment for any other dates outside of the period listed above can be used as credit towards future sitting requests unless the cancelled sittings are a result of an early return home after which the first scheduled sitting has commenced. No refunds or credits will be issued for such cancellations.

Memorial Day Holiday:

  • $15 fee on May 27 itself but none of the surrounding dates.
  • Full payment is due on May 24 or by the start of the first scheduled sitting, whichever comes first.
  • There are no refunds or credits for cancellations between Friday, May 24 – Wednesday, May 29.
  • Payment for any other dates outside of the period listed above can be used as credit towards future sitting requests unless the cancelled sittings are a result of an early return home after which the first scheduled sitting has commenced. No refunds or credits will be issued for such cancellations.

Independence Day Holiday:

  • $15 fee per visit on July 4 itself but none of the surrounding dates.
  • Full payment is due on July 2 or by the start of the first scheduled sitting, whichever comes first.
  • There are no refunds or credits for cancellations between Tuesday, Jul 2 – Saturday, Jul 6.
  • Payment for any other dates outside of the period listed above can be used as credit towards future sitting requests unless the cancelled sittings are a result of an early return home after which the first scheduled sitting has commenced. No refunds or credits will be issued for such cancellations.

Labor Day Holiday:

  • $15 fee per visit on September 2 itself but none of the surrounding dates.
  • Full payment is due on August 30 or by the start of the first scheduled sitting, whichever comes first.
  • There are no refunds or credits for cancellations between Friday, Aug 30 – Tuesday, Sep 3.
  • Payment for any other dates outside of the period listed above can be used as credit towards future sitting requests unless the cancelled sittings are a result of an early return home after which the first scheduled sitting has commenced. No refunds or credits will be issued for such cancellations.

Columbus Day Holiday:

  • $15 fee per visit on October 14 itself but none of the surrounding dates.
  • Full payment is due on October 12 or by the start of the first scheduled sitting, whichever comes first.
  • There are no refunds or credits for cancellations between Saturday, Oct 12 – Wednesday, Oct 16.
  • Payment for any other dates outside of the period listed above can be used as credit towards future sitting requests unless the cancelled sittings are a result of an early return home after which the first scheduled sitting has commenced. No refunds or credits will be issued for such cancellations.

Veteran’s Day Holiday:

  • $15 fee per visit on November 11 itself but none of the surrounding dates.
  • Full payment is due on November 8 or by the start of the first scheduled sitting, whichever comes first.
  • There are no refunds or credits for cancellations between Friday, Nov 8 – Tuesday, Nov 12.
  • Payment for any other dates outside of the period listed above can be used as credit towards future sitting requests unless the cancelled sittings are a result of an early return home after which the first scheduled sitting has commenced. No refunds or credits will be issued for such cancellations.

Thanksgiving Holiday:

  • $15 fee per visit on Nov. 21, 2019.
  • Full payment is due now upon booking for any sittings scheduled between November 19-24, 2019.
  • Changes or cancellations with at least 21 days advance notice prior to first visit are 100% refundable as credit for entire schedule that can be used for future sittings. No cash refunds will be given.
  • Changes or cancellations with less than 21 days advance notice prior to first visit are nonrefundable and cannot be used as credit towards future sittings.
  • We require a 3 daily visit minimum order for sitting requests between November 19-24, 2019.

Christmas/New Year’s Holiday:

  • $15 fee per visit on Dec. 24, 25, 31 and Jan 1, 2020.
  • Full payment is due now upon booking for any sittings scheduled between December 22 – January 2, 2020.
  • Changes or cancellations with at least 21 days advance notice prior to first visit are 100% refundable as credit for entire schedule that can be used for future sittings. No cash refunds will be given.
  • Changes or cancellations with less than 21 days advance notice prior to first visit are nonrefundable and cannot be used as credit towards future sittings.
  • We require a 3 daily visit minimum order for sitting requests between December 22 – January 2, 2020.
